  • Performance specification

    The removal of installations, including structural installations, is also subject to the regulations of the State Building Code, among others.

    A demolition permit is required for

    • Buildings with more than 300m3 gross volume,
    • Buildings used for agriculture, forestry or horticulture with a gross floor area of more than 150 m² and
    • Container over 150 m³ container capacity

    regularly required. Independently of this, the stability of neighbouring buildings must be checked by the building owner if they are built together or if the building ground gives cause for this.

    If approval, permission or consent is required for the removal of the installation according to other regulations, this must be obtained before the removal is started. This depends on the individual case, e.g. according to monument protection, nature conservation or waste law or according to conservation statutes of the municipalities.

  • Requirements

    Demolitions requiring approval are examined in the full procedure according to § 66 HBO. In addition to the contents usually to be examined in this procedure, the focus is on the examination of the demolition and disposal concepts.

    In addition to the building permit, other permits may also be required for your building project. These could be, for example:

    • Tree felling permit
    • Notification under water law for handling substances hazardous to water
    • Permit under water law for groundwater contact

  • What are the fees?

    The fee is charged in accordance with the Administrative Cost Regulations for the Business Division of the Ministry of Economic Affairs, Energy, Transport and Regional Development (VwKostO-MWEVL), unless the competent lower building supervisory authority has its own building supervisory fee statutes. The amount of the fee depends on various factors. Information can be obtained from the competent lower building supervisory authority in individual cases.

  • What deadlines do I have to observe?

    The building inspectorate must be notified in writing of the start of demolition at least one week in advance. The completion of the demolition shall be notified to the building supervision at least 2 weeks in advance, stating the time of completion.

    The demolition permit becomes invalid if demolition is not started within 3 years after it has been granted or if demolition has been interrupted for one year.

    The demolition permit can be extended on application for up to 2 years at a time. This application can be made informally to the building inspectorate, stating the file number.

  • Processing time

    The envisaged approval period in the full procedure is a maximum of 3 months. However, a fiction of the demolition permit after expiry of the deadline is not regulated by law.

    The demolition of buildings without planning permission must also be carried out by a specialist company. The regulations under nature conservation and monument protection law as well as the applicable preservation statutes must be observed.
