Brokerage activities - Permission

    You need a permit if you want to offer the following commercially:

    • Real estate brokerage (real estate agents),
    • Mediation of loan agreements (except real estate loans for consumers),
    • Management of residential real estate (residential real estate manager and residential real estate administrator) or
    • Preparation or implementation of building projects in one's own name or in the name of third parties (property developer, building supervisor)

    Depending on which permit you apply for, you are entitled to carry out the following activities, for example:

    • Brokerage of real estate and rights equivalent to real estate, as well as brokerage of the sale, encumbrance, rental or leasing of real estate
    • Procurement of residential property and contracts for mortgages and land charges,
    • Brokerage of commercial premises as well as residential premises, i.e. all types of space transfers including leases and subleases, i.e. also flat and room brokerage.
    • Mediation of loans (except real estate financing for consumers)
    • Planning or carrying out building projects using assets belonging to third parties, for example with assets belonging to tenants, leaseholders, other beneficial owners or persons applying for acquisition or usage rights. It makes no difference whether you act in your own name (property developer) or whether you act for third parties (building supervisor). The following activities, for example, come into consideration: Submitting building applications, commissioning architects and craftsmen, procuring and calling in financing, taking out insurance, calculating subsequent rents.
    • Administration of rented flats or of the joint condominium ownership of several persons. You are an administrator, for example, if you
      • Carry out resolutions of the condominium owners and ensure the enforcement of the house rules;
      • take the measures necessary for the proper maintenance and repair of the common property;
      • arrange for and receive all payments and services connected with the day-to-day management of the common property;
      • manage funds collected.

    For the brokerage of real estate consumer loan agreements you need a different, separate trade licence.

  • Which documents are required?

    • Copy of identity card or passport with certificate of registration or presentation on site.
    • Proof of orderly financial circumstances
      • usually if resident in Germany:
        • Extract from the debtors' register
        • Certificate of the insolvency court
        • Certificate in tax matters (from the tax office)
      • If you are resident abroad: documents from your home country proving your orderly financial circumstances
    • Proof of entrepreneurial legal form:
      • if the company's registered office is in Germany: for companies entered in a register: Extract from the commercial register or the register of partnerships or the register of cooperatives
      • If the company is domiciled abroad: documents from the country of domicile proving its legal form
    • Proof of personal reliability:
      • if resident in Germany:
        • Certificate of good conduct for submission to an authority
        • Extract from the Central Trade Register for submission to a public authority
      • if you are resident abroad: documents from your country of residence proving your personal reliability

    The competent authority may request further documents to verify personal reliability.
    In the case of legal entities such as a limited liability company, you must submit or apply for the personal documents for all natural persons authorised to manage the company (for example, personal papers) (for example, extract from the commercial central register for submission to an authority).
    For the legal entity, you also need an extract from the central business register for submission to an authority.
    Partnerships such as a GbR, KG, OHG, PartG or GmbH & Co. KG are not eligible for a licence as such.
    Therefore, each managing partner requires a permit. Submit a completed application form and all personal documents for each of these persons.
    If you wish to act as a residential property manager, you must submit proof of taking out the professional liability insurance required by law.

    Real estate agents and residential property managers as well as their staff are obliged to undergo regular further training in accordance with their activities.
