Basic income support in old age and in the event of reduced earning capacity

    Anyone who has reached the age limit (65 years and older, depending on the individual case) or is permanently fully incapacitated for work as an adult for health reasons can receive benefits under the basic income support scheme for old age and reduced earning capacity.

    Basic income support in old age and in the event of reduced earning capacity is intended - like assistance for subsistence - to ensure the necessary subsistence. This applies in particular to the costs of food, accommodation, clothing, personal hygiene, household goods, heating and personal needs of daily life, such as telephone, newspaper or going to a concert.

    In order to determine the needs of a person entitled to benefits, the so-called standard rates must first be used as a basis. In the course of the reform of the social assistance law, these were increased and now also cover all individual needs.
     

    The (reasonable) accommodation and heating costs as well as possible additional requirements due to

    • Age and proof of the "G" mark,
    • full reduction in earning capacity and proof of the mark "G",
    • Single parenthood,
    • costly diet
    • Preparation of hot water (electric)
    • Additional needs in case of pregnancy

    slammed.

    While pension benefits for old age are still taken into account in the case of assistance for subsistence, this is not the case in the case of basic income support.

    Scope of basic security

    The amount of the benefit depends on the level of need; the competent authority must take into account the applicant's own income and assets when calculating the benefit.

    Relatives are only included in the basic income support for any maintenance obligations if their annual income exceeds 100,000.00 Euros. This does not apply to maintenance obligations towards spouses (including former spouses) and civil partners from registered civil partnerships. The legislator has excluded a so-called liability of heirs; the heirs are thus not obliged to reimburse costs incurred for basic security.

    These regulations are intended to make it easier for those affected to take advantage of the assistance.

    Indigence

    The persons concerned must be needy, i.e. their income and assets (or those of their spouse/life partner/life partner) are not sufficient to ensure their necessary subsistence.

    Application

    In order to receive benefits from the basic income support in old age and in case of reduced earning capacity, you as the person concerned or his/her legal representative must submit a written application.

    You can obtain the application forms from the competent authority; forms and information sheets are also available on the internet, depending on what the authority offers.
    You submit the completed application together with the required evidence to the competent authority.
    You will receive written notification as to whether and to what extent the application has been approved.

    Examination of the incapacity to work

    If it needs to be clarified whether there is an incapacity to work, the competent office will contact the competent pension insurance institution.

    The examination by the pension insurance institution does not apply if the persons concerned already receive a pension for permanent reduction in earning capacity or are admitted to a workshop or other institution for disabled persons.

    An entitlement to basic income support benefits exists if the person concerned has his or her usual place of residence in the Federal Republic of Germany and

    • has reached the age limit (65 years and older, depending on the individual case) or
    • is permanently fully incapacitated for work for health reasons after reaching the age of 18.

    The benefit is usually granted for 12 calendar months. Afterwards, a review of the economic and personal circumstances takes place (a new application is not necessary).
