Applying for an exemption from the ban on driving on Sundays and public holidays

Please note in particular our information under:
  • Performance specification

    In Germany, lorries with a gross vehicle weight of over 7.5 tonnes and trailers behind lorries are not permitted to drive on Sundays and public holidays between 0:00 and 22:00.

    The ban does not apply to
     

    • combined road-rail freight transport from the consignor to the nearest suitable loading station or from the nearest suitable unloading station to the consignee, but only up to a distance of 200 km,
    • combined goods transport port-road between a loading or unloading point and a port located within a radius of not more than 150 kilometres (arrival or departure),
    • the carriage of a) fresh milk and fresh milk products, b) fresh meat and fresh meat products, c) fresh fish, live fish and fresh fish products, d) perishable fruit and vegetables,
    • Empty journeys related to journeys referred to in point 2,
    • Journeys with vehicles that are called upon under the Federal Benefits Act.

    The benefit statement must be carried along and handed over to the competent persons for examination upon request.


    Under certain conditions, exceptions to the ban on driving on Sundays and public holidays can be granted.

  • Requirements

    An exemption may only be granted if certain conditions are met, e.g.:

    • Supply of perishable food to the population
    • On-time loading and unloading of seagoing vessels
    • Maintaining the operation of public utilities or transport facilities.

    An exemption is granted after a written application. The application can also be submitted by fax.

  • Which documents are required?

    • Application form with justification,
    • Freight and accompanying documents,
    • if the carriage involves a road journey of more than 100 km, a certificate from the freight office responsible for the place of dispatch stating that it is impossible to carry the goods by rail within the time limit,
    • for cross-border traffic, proof of clearance times at the border customs office for loads on lorries,
    • Motor vehicle and trailer licence (registration certificate part I).
    • For foreign motor vehicles in whose registration documents the permissible gross weight and engine power are not entered, a corresponding official certificate is required.

    The administrative fee is charged in accordance with the Fee Regulations for Road Traffic Measures (GebOSt).
    The amount of the fee depends on numerous different factors.

  • What deadlines do I have to observe?

    An individual permit is valid for one journey with one vehicle or vehicle combination.

    A permanent exemption permit of up to 1 year may only be issued if, in addition to the requirements for an individual permit, the need for regular transport is established.

Who do I need to contact?

Exemptions are granted by the road traffic authorities (counties, independent cities, cities and municipalities with more than 50,000 inhabitants; other cities and municipalities only if the exemption is only valid in the municipal area) in whose district the load is taken up or the road traffic authorities in whose district the applicant has his place of residence, registered office or a branch.
