    Appropriateness of the costs of accommodation and heating for recipients of benefits according to § 22 SGB II or § 35 SGB XII

    Basic rent and cold operating costs:
    Needs for accommodation are recognised in the amount of the actual expenses, as far as they are reasonable.

    Heating costs:
    In addition, there are the needs for heating and central hot water supply. These are recognised in the actual amount, insofar as they are reasonable. The adequacy of the heating costs is assessed on the basis of the respective current nationwide heating index, taking into account the adequate living space and the respective type of heating.

    To clarify whether your flat (basic rent, operating costs and heating costs) is appropriate, you are welcome to contact your responsible case worker at the Social Affairs Department or the Job Centre.

    Moving:
    If you would like to move to another flat, please note the following:

    Before a change of residence, the assurance of the basic income support institution to assume the future costs of accommodation must be obtained.

    • Before renting another flat, the necessity must be clarified. For this purpose, the reasons for the move must be explained
    • Before renting accommodation, the appropriateness must be clarified.
  • Which documents are required?

    Before renting accommodation, the appropriateness must be clarified.

    To do this, submit a detailed rental offer (you can use our "Rental certificate" form for this purpose), which must contain the following mandatory data:

    • Address
    • Flat size
    • Basic rent (cold rent)
    • Cold operating costs
    • Heating costs
    • Other costs (e.g. garage, parking space, furniture, electricity costs, etc.)
  • What else should I know?

    • A prior clarification of the necessity and appropriateness is necessary in your own interest. If you rent a flat without the prior consent of the Social Affairs Department, this can lead to only the reasonable costs being recognised if the flat is inappropriate. Furthermore, additional expenses that may arise in connection with a move (e.g. moving costs, costs of procuring accommodation and rent deposits) will only be approved with prior consent.
    • In case of a move to a place outside the district of Waldeck-Frankenberg, the adequacy must be clarified in advance with the SGB XII agency responsible there.
    • If you do not yet live in the district of Waldeck-Frankenberg and want to move to the district of Waldeck-Frankenberg, the SGB XII agency in whose area you currently live is responsible for checking the necessity and the moving costs.
