    Before you make more detailed plans about how you will build on a plot of land that you have purchased or want to purchase, you should clarify what the associated development plan says.

    The qualified development plan determines in a legally binding manner which buildings and other structures are permissible on a property. Among other things, the following stipulations are made

    • the type of building use (e.g. residential, mixed, commercial area),
    • the degree of building use (e.g. number of storeys and floor area, height, number of full storeys),
    • the construction method (open or closed construction method),
    • to the buildable area of the plot,
    • to the local traffic areas.
       

    The simple development plan, which does not fulfil the requirements of a qualified development plan, only contains individual stipulations as binding regulations and is supplemented by the regulations of §§ 34 and 35 of the Building Code (BauGB), which are to be applied in a supportive manner.


Who do I need to contact?

A development plan is adopted by the municipality as a statute. After that, it becomes legally binding through publication.
