    Since the purchase of real estate usually involves considerable values, a notary must be consulted to conclude the purchase contract, who will put the wishes of the parties involved into a legally impeccable form. After agreeing on any desired changes, the purchase contract must be notarised.

    However, it is often important and helpful to enlist the help of a notary or lawyer right from the start.

    Caution: Concluding a purchase contract does not make you the owner of the property. You only become the owner of the property when it is conveyed to you and entered in the land register. Find out from a notary or lawyer about the possibilities of securing your interests until the transfer of ownership.

    Entry in the land register

    Forentry in the land register you need a clearance certificate from the tax office.

    For this, the notary must first notify the tax office of the purchase of the property. You will then receive a notice of the amount of land transfer tax. You will receive the clearance certificate as a certificate of payment of the land transfer tax.

    Real estate transfer tax

    In addition, the notary must obtain the approval of the municipality and, in the case of agricultural land, the approval of the Fachdienst Landwirtschaft. Under certain conditions, the exercise of the right of first refusal, a refusal or an approval with a condition would be possible.

    At the end of the purchase process there is the registration in the land register.

    The costs of notarial certification are set out in the Law on Costs of Voluntary Jurisdiction for Courts and Notaries (GNotKG). They are based on the transaction value.
